ENGAGEMENT
a. Client must provide clear and complete requirements and expectations upfront, including reference materials and assets(even descriptions) before work begins.b. Artist will contact you in your chosen platform of communication, or where you first messaged by default.c. Artist has the right to decline a request either based on content, subject, or other reasons.d. Artist assures that the Work will be produced in its best form possible, all according to the Client’s wishes as much as possible, otherwise, limitations and boundaries will be communicated and client will be given an option to either accept these limitations or take back the request (Only applicable upon inquiry OR check-ups for Add-ons).

RIGHTS & USAGEa. Artist Rights
- The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display. advertising the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.b. Client Rights.
- Clients receive exclusive, non-transferable usage rights to the Work for personal use.
- Personal use means: display on social media accounts for promotional purposes with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.
- Client must not claim Work as their own, crediting me using my social media username is highly encouraged.
- Client must not edit or modify Work in any way without prior permission from the Artist.c. Commercial Rights
- Commercial rights are not included unless specified in the commission type or listing on the Artist’s sites, or discussed upon during the request/inquiry.
- Commercial rights means usage of Work on streams, videos and other content, or any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform.
- In the case of design work for the definition of the Client's brand identity such as character design, and more, intellectual property rights of the designs are exclusively granted to the Client for use, production and modification purposes, commercial or personal.
- Usage of work for AI (artificial intelligence) tools, platforms or programs, ML (machine learning) tools, platforms or programs, NFT/blockchains or any other for-profit schemes and platforms, ESPECIALLY those notorious for continuously disrespecting the ethics and wishes of the art community are strictly PROHIBITED and the artist does NOT consent to this.

TIMELINE AND PROCESS
a. Work completion undergoes 2 stages: Sketch and Final.b. Sketch Conceptualization may take 1-3 weeks, which will automatically be sent to the client once made. Please note: No response = No progress.c. Overall, Work completion may take around 3 weeks on average, and the slowest being 3 months.d. Timeline may depend on commission type, complexity, as well as the Artist’s schedule and current wellbeing.e. Artist would provide the sketches once its made, and either a confirmation or additional suggestions (if applicable) should be returned. If no response is given, no progress will be made.f. The Final Artwork would be delivered via a Google Drive link. It is advised for the Client to save or back up the file/s within a week, so the Client would still have the copy in case of a drive purge.g. Clients can give out a deadline no less than 2 weeks, this may charge an additional rush fee ($30 USD min. 2 weeks; -$5 USD for every added week).h. The Drive Link will include the following: (1) A .PNG of the artwork with a flat color background, (2) a .PNG of the artwork with a white background, and (3) a transparent .PNG of the artwork. However, Artworks with scenic backgrounds only include the final work.REVISIONS
a. Client has a total of three (3) revisions allowed.b. All concept revisions (pose, composition, character change, design change, etc. ) must be clarified upon receiving the sketch update.c. Small, manageable revisions like slight color changes, erasing/adding missing design elements or moving the watermark to another place in the canvas are all free of charge, even when the Final Artwork has been received.d. Concept Revisions (Pose Change, Character Change, Expression Change etc.) when the final artwork has been made is highly discouraged, and may cost varying additional fees if needed to correct.e. Revisions may affect progress and timeline.

PAYMENT & FEES
- Client must pay the full price before the work is started on.
- NO MORE REFUNDS AFTER SKETCH. If there is still no sketch update sent upon refund request, a 90% refund is applicable, the 10% serves as the cancellation fee. Refunds are no longer applicable once the work is nearly or already finished. Client must recognize that this service is a luxury, and one must be 100% certain of their purchase before going through with the transaction.
- Fees for additional elements such as Backgrounds will not be charged upon request, but only when the sketch update is sent.
- Commissions that cost more than $250 USD can be paid in half, and must be paid in full once the sketch update is received.
- The only applicable payment channels would be Paypal, Ko-Fi, or GCash. In the case of GCash, the conversion rate to follow is $1 US Dollar = 40 Philippine Pesos.
- Clients will receive an invoice once all initial fees (excluding additional fees) have been counted, finalized, and agreed on.
- Client must pay the invoice within 1 week by default, unless stated otherwise, as long as it’s assured. -- The Client will be sent a reminder on the 3rd day, but if a week has passed, the project will be cancelled.
- Prices may vary or change depending on complexity.
- Client warrants they will not issue chargebacks.
- Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.
